Korban Penipuan “Preoder” iPhone Gugat Rihana-Rihani, Minta Uang Rp 16,5 Miliar Dikembalikan
Tujuh dari penipu iPhone pra-pengacara telah mengajukan gugatan perdata terhadap Rihana-Rihani, dan gugatan tersebut tergolong inkonstitusional. Perkara tersebut telah didaftarkan pada 13 Desember 2023 di Sistem Informasi Perkara (SIPP) Pengadilan Negeri Tangerang dengan nomor berkas: 1379/Pdt.G/2023/PN Tng.

“Korban menggugat Rihana-Rihani ada tujuh orang di pengadilan kota. Kerugiannya Rp16,5 miliar,” kata kuasa hukum korban, Odie Hudiyanto, saat dihubungi, Senin (18/12/2023). Odie mengatakan, alasan kliennya menggugat Rihana-Rihani karena mengharapkan uangnya dikembalikan. Selain itu, ketujuh orang tersebut masih didesak untuk mengembalikan uang kepada pihak yang menjualnya. “Ya, mereka ingin uangnya kembali, para korban mengejar mereka secara diam-diam karena meminta uang kembalian.

Padahal uangnya sudah diberikan kepada si kembar, kata Odie. Inilah salah satu alasan mereka menggugat si kembar ke pengadilan, karena tidak jelas apakah klien saya yang mencuri uang tersebut. ditambahkan. Sekadar informasi, sekelompok hakim mengumumkan bahwa terdakwa Rihana-Rihani secara sah dan jelas merupakan terdakwa yang salah dalam kasus penipuan iPhone terhadap resellernya.

Rihana terbukti melanggar Pasal 45 ayat (1) rujuk Pasal 28 ayat (1) Undang-Undang Nomor 19 Tahun 2016 Tentang Reformasi dan Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Perdagangan Elektronik (ITE). Majelis hakim memvonis Rihana minimal empat tahun penjara dan denda Rp1 miliar, satu lagi delapan bulan penjara.

Sementara itu, sekelompok hakim mengumumkan bahwa terdakwa Rihani secara hukum dan kuat yakin melakukan korupsi dalam kasus penipuan iPhone terhadap penjualnya.

Terdakwa Rihani divonis tiga tahun penjara. Terbukti melanggar Pasal 372 juncto Pasal 64 ayat (1) KUHAP tentang penjualan uang. Kasus penipuan Rihana-Rihani sudah dilaporkan sejak tahun lalu oleh para korban, yakni pada Juni-Oktober 2022. Setidaknya, ada lebih dari 18 laporan polisi mengenai kejahatan yang dilakukan si kembar.

Para korban melaporkannya ke berbagai tempat, mulai dari Polres Tangsel (Polres), Polres Metro Jakarta Selatan, dan Polda Metro Jaya. Rihana-Rihani memulai penipuannya dengan menjual iPhone ke reseller. Keduanya menggunakan sistem pesanan pertama untuk menarik pelanggan. Korban dijanjikan iPhone dengan harga lebih murah dari harga eceran.
